What if maintenance fee increase exceeds contract provision?

My contract states "annual fee increase based on U.S. CPI, not to exceed 10%".  2016 fee is increase of 8.8% over 2015 fee while 2015-2016 CPI increased by less than 1%.  Resort says the "not over 10%" part applies but the CPI is only one factor and that "Mexican factors account for the large increase".  I'd like to dispute this legally but am not sure of my options.  I suppose I would need an attorney.
