refusal to pay maintenance fees

I have a timeshare annual maintenance fee that is due 9/15/16.  I also just signed up with a company to exit our timeshare (to get us out legally).  What are the repercussions/consequences if I don't pay the maintenance fee coming up in September?  I know it would affect my credit rating, send me late fee statements and send me to a collection agency.  The mortgage payment is paid off and all my past maintenance fees are current (nothing is past due as yet).  My question is, would the timeshare company also send me a 'summons' to appear in court and force me to pay a lot of extra money?
